Do You Want to Be a Dealer at DerpyCon 2023?

Thank you for your interest in being a Dealer at DerpyCon 2023.  Below you will find rules, policies, and information regarding being in our Dealers Room.  Please read all rules and policies before applying.  If you have any questions, please contact the Dealers Room Head.

Our Dealers Room Applications will open on May 17, 2023 and close on June 21, 2023 at 11:59pm EDT.  You will be contacted by our Dealers Room Head in early July informing you whether or not you have been awarded a spot in our Dealers Room.  If you have been accepted, full payment information will be provided at that time.

This page sets forth the regulations for the DerpyCon 2023 Dealers Room.  By applying for space in the DerpyCon 2023 Dealers Room, you (the Dealer) agree to abide by these regulations.

Applications Now Closed

Juried Dealers Room

We select all of our dealers by a jury selection; that is to say that all applicants will be reviewed based on content only. Having a jury system allows us to keep our Dealers Room diverse in selection so that not every table is showcasing the same style or product type.

To aid in this process, please fill out your application (found at the bottom of this page) clearly and completely. The more information on your work that you provide, the better we can judge your application. We receive many more applications than we can accept and having samples of your work or previous convention tables will greatly aid in our process.

Dealers Room Rates

One (1) Dealers Booth Space is $350 and Consists Of:

  • One (1) 8ft x 8ft Space
  • One (1) 6ft x 2.5ft Table
  • Two (2) DerpyCon 2023 Dealers Badges
  • Two (2) Chairs
  • Wireless Internet Access

Additional dealer badges can be purchased at a rate of $40 each.

Additional booth spaces can be purchased at a rate of $350 each (max 3 total spaces).

Payment will be arranged via Stripe via DerpyCon’s Payments Center website, or via check or money order by mail. DerpyCon will hold your space for fourteen (14) days for payment. Failure to pay by that time will result in forfeiture of your booth. Dealers are not permitted to resell spaces.

Dealers that have paid and cancel prior to August 21, 2023 will receive a full refund.  Any cancellations on or after August 21, 2023 will result in complete forfeiture of payment and table. All refund requests must be made via email to the Dealers Room Head only – no other refund requests will be accepted. All refunds will be issued thirty (30) days after DerpyCon 2023 concludes. No refunds will be issued for cancellations during DerpyCon 2023.

DerpyCon is not responsible for any expenses incurred by the Dealer while preparing for exhibiting at DerpyCon 2023.

Dealers Room Policies
  • Dealers must be 18 years of age or older to obtain a booth at the convention (or have turned 18 between the time of application and the convention).
  • All Dealers within a booth must have a Dealers Room badge.
  • Dealers must abide by all convention policies, all rules set forth on this page, and any written or verbal rules set forth by the Dealers Room Head or Con Chair.
  • Displays may not be wider than the booth, hang into the walkways, or encroach or block other Dealers’ booths/space.
  • Displays must be steady and able to secured without being held.
  • No bootlegs or unlicensed reporductions of existing merchandise may be sold.
  • No industrial machines or flammable materials, sich as airbrushes, high-pressure cans, or flammable supplies, are to be at the table.
  • No music may be played at the table out of respect for fellow artists and attendees.
  • Sexually explicit and provocative material will not be permitted.
  • Dealers must abide by all state and federal laws, especially concerning copyright laws and restricted sales of unsafe or inappropriate products to minors.
What Can You Sell?
  • Any licensed authentic US merchandise.
  • Any licensed authentic imported merchandise.
  • Any products featuring your own creations.
  • Used goods (that are legitimate) that are clearly labelled as such.
  • Art that is explicitly your own work (no plagiarizing).
  • Commissioned works.
What Can't You Sell?
  • Dangerous merchandise, including, but not limited to: weapons, loud noisemakers, combustible items, and items that could easily cause harm.
  • Knockoff or bootleg merchandise.
  • Bootleg videotapes, video CDs, or DVDs (this includes bootlegged videos recorded on blank videotapes with printed labels, pirate copies of any titles that have been released commercially in the United States, Japan, or elsewhere, or titles taped off the air in Japan – and any and all fansubs).
  • Any posters, idol cards, etc. which read “Kodak”, “Fuji”, etc. on the back.
  • Unlicensed reproductions of any products, regardless of whether they are released by an American company.
  • Contact lenses or any other kind of regulated medical device.
  • Food, snacks, beverages, or items of the sort.
  • Merchandise depicting a child-like character in an erotic or sexual manner.
  • Sexually explicit/provocative material.

If you are caught or reported to be selling ANY of the above banned items, or anything else deemed banned by the Artist Alley Head, Head of Publicity, or Con Chair, DerpyCon reserves the right to dismiss your table from the convention with no refund. A first warning given should be considered your last, and any warnings after that will result in expulsion from the convention and forfeiture of all fees.

Adult Material Policy

DerpyCon DOES NOT allow for the sale of Adult Material. All sexually explicit or provocative content (including hentai and pornography) is banned. We ask all Dealers, particularly those who sell adult material, to keep in mind that this is a family-friendly convention and that minors will be present. Think PG-13.

Any material that contains nudity or is otherwise unsuitable for minors (anyone below the age of 18) is prohibited. This includes artistic nudes.

Dealers who display prohibited adult material in the general public’s view or attempt to sell it will be reminded once about our adult material policy. Failure to comply with warnings will result in removal from the convention and forfeiture of all fees.

Bootleg Policy

DerpyCon has a strict NO BOOTLEG policy. We will have zero-tolerance for any Dealers that do not comply with our policies regarding bootlegs and trademark violations. Any Dealers found to be selling bootleg (or illegal to distribute) merchandise will be issued a warning and be asked to remove the item(s) from the table for the remainder of the convention. Failure to do so will result in immediate expulsion from the convention, revocation of badges, and a possible disqualification from participating in future events.

Security and Overnight

The Dealers Room will be locked when the room is not open.  You will not be able to access your booth outside of the times listed above.

Check-In & Move-Out Policies

Prior to setting up your booth, all dealers must check-in with the Dealers Room Head.  Here, you will obtain your badges and be shown your booth.  More details about this will be provided to accepted dealers closer to the convention weekend.

Dealers are solely responsible for moving in all necessary merchandise and equipment.  Dealers will have access to the loading docks, with a schedule to be announced.  If your vehicle is over 6 feet tall, you must used to the loading dock.  There is overnight parking available, however if your vehicle is oversized (over 6 feet tall) you must notify the Dealers Head no later than 50 days prior to the convention to get a parking permit.

Tax ID

Each Dealer will need to register to collect sales tax in NJ. New Jersey law requires all Dealers, even “one-time” Dealers, to register with the State for tax purposes at least 15 business days before starting business, and to collect New Jersey sales tax on all sales of taxable tangible personal property or services. There are no special provisions for temporary Dealers. Once registered, you must file all required returns until you properly end your tax registration with New Jersey. File Form NJ-REG (Business Registration Application) to register with the State to collect/remit New Jersey taxes such as sales tax or employee withholdings, and to obtain a New Jersey tax identification number. You can register online or file a paper application. DerpyCon is not responsible for the Dealer registration to New Jersey State for collecting sales tax.

DerpyCon has the right to remove a Dealer without refund if a Proof of Registration certificate is missing or not valid. To obtain a proof of registration, visit http://www.state.nj.us/treasury/revenue/proofreg.shtml

General Notices
  • No outside food or beverages are allowed in the Dealers Room.
  • Be respectful of your neighbors and other con goers.
  • If you have any issues, complaints, or disputes, please bring it to the attention of the staff – Dealers Room staff will have the final say in all solutions.
  • Please keep your things in your allotted space
  • Please refrain from storing trash or empty storage boxes at your booth or in the room.
  • DerpyCon reserves the right to prohibit the sale or advertising of any merchandise or service.
Dealers Room Contract

JENTHONY ENTERPRISES, INC. (HEREAFTER “THE PROMOTER”) AND THE HYATT REGENCY NEW BRUNSWICK (HEREAFTER “THE CONVENTION SPACE”, THEIR RESPECTIVE OFFICIALS, SUBSIDIARIES, AGENTS, AFFILIATES, OPERATORS, OFFICERS, VOLUNTEERS AND EMPLOYEES (HEREAFTER ” THE INDEMNIFIED PARTIES”) WILL NOT BE LIABLE FOR ANY INJURY, LOSS, OR DAMAGE THAT MAY OCCUR TO THE DEALER OR THE DEALER’S EMPLOYEES OR PROPERTY FROM ANY CAUSE WHATSOEVER. THE PROMOTER WILL NOT BE LIABLE FOR FAILURE TO PERFORM ITS OBLIGATIONS UNDER THIS DOCUMENT AS A RESULT OF STRIKES, RIOTS, ACTS OF GOD, OR OTHER CAUSES OF ANY KIND WHATSOEVER NOT WITHIN THE CONTROL OF THE PROMOTER. ANYONE VISITING, VIEWING, OR OTHERWISE PARTICIPATING IN THE DEALER’S EXHIBIT IS DEEMED TO BE THE INVITEE OR LICENSEE OF THE DEALER, RATHER THAN THE INVITEE OR LICENSEE OF THE PROMOTER. THE PROMOTER WILL NOT BE LIABLE FOR ANY INJURY WHATSOEVER TO THE PERSONS CONDUCTING OR OTHERWISE PARTICIPATING IN THE CONDUCT OF THE DEALER’S EXHIBIT OR TO INVITEES, LICENSEES OR GUESTS OF THE DEALER. THE DEALER ASSUMES FULL RESPONSIBILITY FOR THE ACTIONS OF ITS AGENTS, EMPLOYEES, OR INDEPENDENT CONTRACTORS, WHETHER ACTING WITHIN OR WITHOUT THE SCOPE OF THEIR AUTHORITY AND AGREES TO HOLD HARMLESS THE INDEMNIFIED PARTIES FROM RESPONSIBILITY OR LIABILITY RESULTING DIRECTLY OR INDIRECTLY, OR JOINTLY, FROM OTHER CAUSES WHICH ARISE BECAUSE OF THE ACTIONS OR OMISSIONS OF ITS AGENTS, EMPLOYEES, OR INDEPENDENT CONTRACTORS. THE DEALER UNDERSTANDS THAT NEITHER THE PROMOTER NOR THE CONVENTION SPACE MAINTAINS INSURANCE COVERING THE DEALER’S PROPERTY. IT IS THE SOLE RESPONSIBILITY OF THE DEALER TO OBTAIN SUCH INSURANCE. THERE IS NO OTHER AGREEMENT OR WARRANTY BETWEEN THE DEALER AND THE PROMOTER EXCEPT AS SET FORTH IN THIS DOCUMENT. THE RIGHTS OF THE PROMOTER UNDER THIS DOCUMENT IS DEEMED WAIVED EXCEPT AS SPECIFICALLY STATED IN WRITING AND SIGNED BY AN AUTHORIZED OFFICER OF THE PROMOTER. ANY ACTION, WHICH THE PROMOTER OR THE DEALER MAY BRING AGAINST EACH OTHER, BASED UPON OR IN ANY WAY RELATED TO THIS DOCUMENT OR ITS PERFORMANCE, IS BROUGHT FORTH IN FEDERAL OR STATE COURT LOCATED WITHIN THE STATE OF NEW JERSEY, AND THE PROMOTER AND THE DEALER HEREBY WAIVE ALL QUESTIONS OF PERSONAL JURISDICTION OR VENUE IN ORDER TO GIVE EFFECT OF THIS PROVISION. THE DEALER AGREES TO ASSUME ALL RISK, AND TO INDEMNIFY AND HOLD HARMLESS THE PROMOTER AND THE INDEMNIFIED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, DEFENSE COSTS, LIABILITY, EXPENSE OR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE PROMOTER’S USE OF THE LEASED PREMISES OR ARISING OUT OF ANY ACT OR OMISSION OF THE PROMOTER OR ANY OF THE PROMOTER’S EMPLOYEES, AGENTS, CONTRACTORS, REPRESENTATIVES, PATRONS, GUESTS OR INVITEES; EXCEPTING SUCH CLAIMS, DEMANDS, DEFENSE COSTS, LIABILITY, EXPENSE, OR DAMAGES ARISING OUT OF THE SOLE NEGLIGENCE OF ONE OF THE INDEMNIFIED PARTIES. THE DEALER ASSUMES RESPONSIBILITY AND AGREES TO DEFEND THE INDEMNIFIED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, DEFENSE COSTS, LIABILITY, EXPENSE OR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE DEALER’S OR THE PROMOTER’S USE OF THE LEASED PREMISES. NEITHER THE PROMOTER NOR THE INDEMNIFIED PARTIES WILL BE RESPONSIBLE FOR ANY INJURY, LOSS, OR DAMAGE THAT MAY OCCUR TO THE DEALER, THE DEALER’S EMPLOYEES, OR PROPERTY FROM ANY CAUSE WHATSOEVER. DERPYCON WILL PROVIDE UNARMED SECURITY GUARD SERVICE FOR THE EXHIBITION SPACE DURING THE HOURS THE EXHIBIT PREMISES ARE CLOSED. HOWEVER, DEALERS ARE SOLELY AND FULLY RESPONSIBLE FOR THEIR EXHIBIT MATERIAL. ALL PROPERTY OF A DEALER IS UNDERSTOOD TO REMAIN IN THE DEALER’S CARE, CUSTODY AND CONTROL IN TRANSIT TO OR FROM OR WITHIN THE CONFINES OF THE EXHIBIT PREMISES.

DEALERS UNDERSTAND THAT DERPYCON RESERVES THE RIGHT TO USE THE DEALER’S NAME OR IMAGE FOR PROMOTIONAL PURPOSES. DEALERS ALSO UNDERSTAND THAT DERPYCON RESERVES THE RIGHT TO RELEASE A VENDOR’S CONTACT INFORMATION TO THE PUBLIC. SHOULD ANY PROVISION OF THIS DOCUMENT BE RENDERED OR DECLARED INVALID BY REASON OF ANY EXISTING OR SUBSEQUENTLY ENACTED LEGISLATION OR BY ANY DECREE BY A COURT OF COMPETENT JURISDICTION, SUCH INVALIDATION OF SUCH PART OR PORTION OF THIS DOCUMENT WILL NOT INVALIDATE THE REMAINING PORTIONS, AND THEY WILL REMAIN IN FULL FORCE AND EFFECT.
