Do You Want to Be an Artist at DerpyCon 2023?

Thank you for your interest in being an Artist at DerpyCon 2023.  Below you will find rules, policies, and information regarding being in our Artist Alley.  Please read all rules and policies before applying.  If you have any questions, please contact the Artist Alley Head.

Our Artists Alley Application Form will open on May 17, 2023 and close on June 21, 2023 at 11:59pm EDT.  Once you complete the form, you’re application will be added to our jury – no need to contact us regarding if you have been added.  You will be contacted by our Artists Alley Head informing you whether or not you have been awarded a spot in our Artist Alley or on out Waitlist during the early part of July.  If you have been accepted, full payment information will be provided at that time.

This page sets forth the regulations for the DerpyCon 2023 Artist Alley.  By applying for space in the DerpyCon 2023 Artist Alley, you (the Artist) agree to abide by these regulations.

Applications Now Closed

Juried Artist Alley

We select all of our artists by a jury selection; that is to say that all applicants will be reviewed based on content only. Having a jury system allows us to keep our Artist Alley diverse in selection so that not every table is showcasing the same style or product type.

To aid in this process, please fill out your application (found at the bottom of this page) clearly and completely. The more information on your work that you provide, the better we can judge your application. We receive many more applications than we can accept and having samples of your work or previous convention tables will greatly aid in our process.

Artist Alley Rates

An Artist Alley Table is $150 and Consists Of:

  • One (1) 6ft x 2.5ft Table
  • One (1) DerpyCon 2023 Artist Badge

Additional artist badges can be purchased at a rate of $40 each.

Any and all electricity requests must be made via the application.  There are a limited number of electrical outlets in the Artist Alley.  If you request electricity we will try to place you near the outlet. However, you will need to provide your own extension cord.

Payment will be arranged via Stripe via DerpyCon’s Payments Center website, or via check or money order by mail. DerpyCon will hold your space for fourteen (14) days for payment. Failure to pay by that time will result in forfeiture of your table. Artists are not permitted to resell tables.

Artists that have paid and cancel prior to August 21, 2023 will receive a full refund.  Any cancellations on or after August 21, 2023 will result in complete forfeiture of payment and table. All refund requests must be made via email to the Artist Alley Head only – no other refund requests will be accepted. All refunds will be issued thirty (30) days after DerpyCon 2023 concludes. No refunds will be issued for cancellations during DerpyCon 2023.

DerpyCon is not responsible for any expenses incurred by the Artist while preparing for exhibiting at DerpyCon 2023.

Artist Alley Policies
  • Artists must be 18 years of age or older to obtain a table at the convention (or have turned 18 between the time of application and the convention).
  • All Artists behind the table must have an Artist Alley badge.
  • Artists must abide by all convention policies, all rules set forth on this page, and any written or verbal rules set forth by the Artist Alley Head or Con Chair.
  • Displays may be no more than 8ft high from the floor.
  • Displays may not be wider than the table, hang into the walkways, or encroach or block other artists tables/space.
  • Displays must be steady and able to secured without being held.
  • Any displays behind the table can be no more than 3ft behind the table and cannot block any walkways or prevent access to the space.
  • No bootlegs or unlicensed reporductions of existing merchandise may be sold.
  • No industrial machines or flammable materials, sich as airbrushes, high-pressure cans, or flammable supplies, are to be at the table.
  • No music may be played at the table out of respect for fellow artists and attendees.
  • Sexually explicit and provocative material will not be permitted.
What Can You Sell?
  • Your artwork, as in it must be made by you (or a member of your studio)
  • Fan art that is explicitly your own work (no plagiarizing).
  • Commissioned work.

Note: Artist Alley is NOT a replacement for the Dealers Room. If you plan on selling licensed merchandise, you MUST apply for a Dealers Room space. Any Artist Alley Applications with licensed merchandise will be DENIED.

What Can't You Sell?
  • Copied or traced artwork.
  • Bootleg merchandise.
  • Plagiarized artwork, of any kind.
  • Legal, imported merchandise.
  • Unlicensed reproductions of merchandise.
  • Sexually explicit/provocative material.
  • Food or beverages.
  • Dangerous merchandise, including, but not limited to, weapons, live steel, noisemakers, flammable items, any items that can easily cause harm, and any items that could be easily mistaken as a weapon.

If you are caught or reported to be selling ANY of the above banned items, or anything else deemed banned by the Artist Alley Head, Head of Publicity, or Con Chair, DerpyCon reserves the right to dismiss your table from the convention with no refund. A first warning given should be considered your last, and any warnings after that will result in expulsion from the convention and forfeiture of all fees.

Adult Material Policy

DerpyCon DOES NOT allow for the sale of Adult Material. All sexually explicit or provocative content (including hentai and pornography) is banned. We ask all Artists, particularly those who sell adult material, to keep in mind that this is a family-friendly convention and that minors will be present. Think PG-13.

Any material that contains nudity or is otherwise unsuitable for minors (anyone below the age of 18) is prohibited. This includes artistic nudes.

Artists who display prohibited adult material in the general public’s view or attempt to sell it will be reminded once about our adult material policy. Failure to comply with warnings will result in removal from the convention and forfeiture of all fees.

Bootleg Policy

DerpyCon has a strict NO BOOTLEG policy. We will have zero-tolerance for any Artists that do not comply with our policies regarding bootlegs and trademark violations. Any Artists found to be selling bootleg (or illegal to distribute) merchandise will be issued a warning and be asked to remove the item(s) from the table for the remainder of the convention. Failure to do so will result in immediate expulsion from the convention, revocation of badges, and a possible disqualification from participating in future events.

These times are subject to change.

Security and Overnight

The Artist Alley Room will be locked when the room is not open. You will not be able to access your table outside of the times dedicated for set-up, tear-down, and open hours.

Check-In & Move-Out Policies

Prior to setting up your table, all artists must check-in with the Artist Alley Head.  Here, you will obtain your badges and be shown your table.  More details about this will be provided to accepted artists closer to the convention weekend.

Artists are solely responsible for moving in all necessary merchandise and equipment.

Tax ID

Each artist alley member selling will need to register to collect sales tax in NJ. New Jersey law requires all vendors, even “one-time” vendors, to register with the State for tax purposes at least 15 business days before starting business, and to collect New Jersey sales tax on all sales of taxable tangible personal property or services. There are no special provisions for temporary vendors.

Once registered, you must file all required returns until you properly end your tax registration with New Jersey. File Form NJ-REG (Business Registration Application) to register with the State to collect/remit New Jersey taxes such as sales tax or employee withholdings, and to obtain a New Jersey tax identification number. You can register online or file a paper application. DerpyCon is not responsible for the artist registration to New Jersey State for collecting sales tax.

DerpyCon has the right to remove a artist if a Proof of Registration certificate is missing or not valid. To obtain a proof of registration, visit http://www.state.nj.us/treasury/revenue/proofreg.shtml.

General Notices
  • No outside food or beverages are allowed in the Artist Alley.
  • Be respectful of your neighbors and other con goers.
  • If you have any issues, complaints, or disputes, please bring it to the attention of the staff – Artist Alley staff will have the final say in all solutions.
  • Please keep your things in your allotted space.
  • Please refrain from storing trash or empty storage boxes at your table or in the room.
  • DerpyCon reserves the right to prohibit the sale or advertising of any merchandise or service.
Artist Alley Contract

JENTHONY ENTERPRISES, INC. (HEREAFTER “THE PROMOTER”) AND THE HYATT REGENCY NEW BRUNSWICK (HEREAFTER “THECONVENTION SPACE”, THEIR RESPECTIVE OFFICIALS, SUBSIDIARIES, AGENTS, AFFILIATES, OPERATORS, OFFICERS, VOLUNTEERS AND EMPLOYEES (HEREAFTER ” THE INDEMNIFIED PARTIES”) WILL NOT BE LIABLE FOR ANY INJURY, LOSS, OR DAMAGE THAT MAY OCCUR TO THE ARTIST OR THE ARTIST’S EMPLOYEES OR PROPERTY FROM ANY CAUSE WHATSOEVER. THE PROMOTER WILL NOT BE LIABLE FOR FAILURE TO PERFORM ITS OBLIGATIONS UNDER THIS DOCUMENT AS A RESULT OF STRIKES, RIOTS, ACTS OF GOD, OR OTHER CAUSES OF ANY KIND WHATSOEVER NOT WITHIN THE CONTROL OF THE PROMOTER. ANYONE VISITING, VIEWING, OR OTHERWISE PARTICIPATING IN THE ARTIST’S EXHIBIT IS DEEMED TO BE THE INVITEE OR LICENSEE OF THE ARTIST, RATHER THAN THE INVITEE OR LICENSEE OF THE PROMOTER. THE PROMOTER WILL NOT BE LIABLE FOR ANY INJURY WHATSOEVER TO THE PERSONS CONDUCTING OR OTHERWISE PARTICIPATING IN THE CONDUCT OF THE ARTIST’S EXHIBIT OR TO INVITEES, LICENSEES OR GUESTS OF THE ARTIST. THE ARTIST ASSUMES FULL RESPONSIBILITY FOR THE ACTIONS OF ITS AGENTS, EMPLOYEES, OR INDEPENDENT CONTRACTORS, WHETHER ACTING WITHIN OR WITHOUT THE SCOPE OF THEIR AUTHORITY AND AGREES TO HOLD HARMLESS THE INDEMNIFIED PARTIES FROM RESPONSIBILITY OR LIABILITY RESULTING DIRECTLY OR INDIRECTLY, OR JOINTLY, FROM OTHER CAUSES WHICH ARISE BECAUSE OF THE ACTIONS OR OMISSIONS OF ITS AGENTS, EMPLOYEES, OR INDEPENDENT CONTRACTORS. THE ARTIST UNDERSTANDS THAT NEITHER THE PROMOTER NOR THE CONVENTION SPACE MAINTAINS INSURANCE COVERING THE ARTIST’S PROPERTY. IT IS THE SOLE RESPONSIBILITY OF THE ARTIST TO OBTAIN SUCH INSURANCE. THERE IS NO OTHER AGREEMENT OR WARRANTY BETWEEN THE ARTIST AND THE PROMOTER EXCEPT AS SET FORTH IN THIS DOCUMENT. THE RIGHTS OF THE PROMOTER UNDER THIS DOCUMENT IS DEEMED WAIVED EXCEPT AS SPECIFICALLY STATED IN WRITING AND SIGNED BY AN AUTHORIZED OFFICER OF THE PROMOTER. ANY ACTION, WHICH THE PROMOTER OR THE ARTIST MAY BRING AGAINST EACH OTHER, BASED UPON OR IN ANY WAY RELATED TO THIS DOCUMENT OR ITS PERFORMANCE, IS BROUGHT FORTH IN FEDERAL OR STATE COURT LOCATED WITHIN THE STATE OF NEW JERSEY, AND THE PROMOTER AND THE ARTIST HEREBY WAIVE ALL QUESTIONS OF PERSONAL JURISDICTION OR VENUE IN ORDER TO GIVE EFFECT OF THIS PROVISION. THE ARTIST AGREES TO ASSUME ALL RISK, AND TO INDEMNIFY AND HOLD HARMLESS THE PROMOTER AND THE INDEMNIFIED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, DEFENSE COSTS, LIABILITY, EXPENSE OR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE PROMOTER’S USE OF THE LEASED PREMISES OR ARISING OUT OF ANY ACT OR OMISSION OF THE PROMOTER OR ANY OF THE PROMOTER’S EMPLOYEES, AGENTS, CONTRACTORS, REPRESENTATIVES, PATRONS, GUESTS OR INVITEES; EXCEPTING SUCH CLAIMS, DEMANDS, DEFENSE COSTS, LIABILITY, EXPENSE, OR DAMAGES ARISING OUT OF THE SOLE NEGLIGENCE OF ONE OF THE INDEMNIFIED PARTIES. THE ARTIST ASSUMES RESPONSIBILITY AND AGREES TO DEFEND THE INDEMNIFIED PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, DEFENSE COSTS, LIABILITY, EXPENSE OR DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH THE ARTIST’S OR THE PROMOTER’S USE OF THE LEASED PREMISES. NEITHER THE PROMOTER NOR THE INDEMNIFIED PARTIES WILL BE RESPONSIBLE FOR ANY INJURY, LOSS, OR DAMAGE THAT MAY OCCUR TO THE ARTIST, THE ARTIST’S EMPLOYEES, OR PROPERTY FROM ANY CAUSE WHATSOEVER. DERPYCON WILL PROVIDE UNARMED SECURITY GUARD SERVICE FOR THE EXHIBITION SPACE DURING THE HOURS THE EXHIBIT PREMISES ARE CLOSED. HOWEVER, ARTISTS ARE SOLELY AND FULLY RESPONSIBLE FOR THEIR EXHIBIT MATERIAL. ALL PROPERTY OF AN ARTIST IS UNDERSTOOD TO REMAIN IN THE ARTIST’S CARE, CUSTODY AND CONTROL IN TRANSIT TO OR FROM OR WITHIN THE CONFINES OF THE EXHIBIT PREMISES.

ARTISTS UNDERSTAND THAT DERPYCON RESERVES THE RIGHT TO USE THE ARTIST’S NAME OR IMAGE FOR PROMOTIONAL PURPOSES. ARTISTS ALSO UNDERSTAND THAT DERPYCON RESERVES THE RIGHT TO RELEASE A VENDOR’S CONTACT INFORMATION TO THE PUBLIC. SHOULD ANY PROVISION OF THIS DOCUMENT BE RENDERED OR DECLARED INVALID BY REASON OF ANY EXISTING OR SUBSEQUENTLY ENACTED LEGISLATION OR BY ANY DECREE BY A COURT OF COMPETENT JURISDICTION, SUCH INVALIDATION OF SUCH PART OR PORTION OF THIS DOCUMENT WILL NOT INVALIDATE THE REMAINING PORTIONS, AND THEY WILL REMAIN IN FULL FORCE AND EFFECT.
